GST ON IMPORT OF GOODS Introduction India's GST framework imposes tax on import of goods through a specific mechanism designed to maintain neutrality between domestic supply and cross-border procurement. The Integrated Goods and Services Tax Act, 2017 ("IGST Act") provides for levy of GST as per the Customs Tariff Act, 1975 ("CTA") and also, adopts valuation and time of supply as per Customs Act, 1962. Two distinct charges arise on import of goods: (a) Basic Customs Duty ("BCD") under the Customs Act, 1962 and the CTA; and (b) Integrated Tax (“IGST”) under Section 5 of the IGST Act read with Section 3 of CTA. Additionally, various Cesses and Surcharges are leviable on imports under Customs Law. This write-up focuses exclusively on the IGST component and its intersection with Customs Law.
