Complexities of The Judicial Landscape

Introduction: As we increasingly notice, there is no end to litigation in India. The hierarchical system in the judiciary contributes to delays in imparting justice. Every Court takes its own sweet time to decide the cases in the light of the culture of seeking adjournments by the interested litigant and the Courts being liberal in acceding to such requests. There is no delivery timeline when the case is closed for an order after prolonged proceedings. Again, it takes time for the parties to obtain copies of the orders at cost. People with limited resources leave the matter at this stage while the rich or adamant ones opt for challenging such an order before the next higher Court where the case goes through the same rigmarole as in the lower Court. The keen ones and those feeling wronged continue to climb the steps of the upper Courts in search of justice till the matter reaches the Supreme Court.
