Whether Landowners are liable jointly with Developer of there are termination of Development Agreement by the landowner ? The Hon’ble Supreme Court vide its order dated 29th August 2024 in the matter of Akshay & Anr vs Aditya & Ors in Civil Appeal in five matters decided by NCDRC had occasion to consider the issue of obligation of the landowner. Facts of the Case:- This set of five appeals arises from the NCDRC order dated 28-11-2017 wherein NCDRC have upheld the order dated 10-07-2017 passed by Maharashtra State Consumer Dispute Redressal Commission. The lower courts have dismissed the petition filed by the Appellant being landowners. The landowners cannot be allowed to escape from their liabilities and obligations towards home buyers. .......
